1- ENTRY CONDITIONS FOR THE BAILIFFS’ PROFESSION


Standard general conditions
French nationality in accordance with the Nationality Code
No criminal record or disciplinary record non-amnested nor personal bankruptcy

Professional conditions
Have a Master of Laws degree or pre-doctorate diploma in law or a qualification which is recognized as equivalent to a Master’s degree in law such as :

*Doctorate in law;
*A university qualification after five years of study known as a D.E.A. (diplôme d'études approfondies) or a D.E.S.S. (diplôme d'études supérieures spécialisées) in a legal discipline
*Master’s Degrees in science, technical or legal disciplines
*Notary’s practice diploma
*Lawyer’s practice diploma
*Diploma of the Co-managed Free Autonomy Faculty of Economics and Law of Paris

2- COMPULSORY 2 YEAR TRAINEESHIP IN A BAILIFF’S OFFICE


Finding your traineeship post
It is for you to make the efforts required to find your traineeship in a firm of bailiffs.

The most favourable period for searching and finding a traineeship is between 1st June and 30 September so that you will be able to register in time for the theoretical training programme provided by the Department for the training of trainee bailiffs (Département Formation des Stagiaires).

The national chamber is not a clearing house for training vacancies and demands but several possibilities are open to you :
*Consult offers of traineeships in our classified ads column and don’t forget to make your own ad which will be published on line and in the bi-monthly Bailiffs’ New Journal magazine (Nouveau Journal des Huissiers de Justice).
*You can also make enquiries at the Departmental Chambers.

Compulsory registration in the training register

When you have found a training supervisor to welcome you, it is your duty as soon as you have started working in the firm to register as quickly as possible in a register specially used for this purpose by the departmental chamber concerned.

BE CAREFUL: a two year contract is only available if your employer chooses to make a professional training contract (in order to make such a contract it is imperative to contact the National School of Procedure - l'Ecole Nationale de Procédure).
In fact, the fixed term contract at common law cannot exceed eighteen months.

The date of registration is the starting point for the two year period of the traineeship.

Do not forget to request a copy of the contract. This document is indispensable for your inscription file at the Department for the Training of Trainees (Département Formation des Stagiaires).


3- AT THE SAME TIME AS THE TRAINEESHIP, COMPULSORY TRAINING AT THE D.F.S. AND SUPPLEMENTARY TRAINING OF THE E.N.P.E.P.P.


The aim of the D.F.S. is to prepare the trainees for the bailiffs’ professional examination.

Registration
* Applications should be submitted from 1st July.
* The closing date for applications and registration is 30th September. STRICTLY NO DISPENSATIONS ALLOWED

To send your application for registration, it is imperative that you leave your postal address by email audfs@huissier-justice.fr

The cost of the training is 300 Euros per year. The application for registration must be addressed to the Secretariat of the Training Department for Trainees (secrétariat du Département Formation des Stagiaires).

Advice :
In order to save time, immediately request 2 copies of your criminal record bulletin n°3 (le bulletin n°3 du casier judiciaire) which is indispensable for registration purposes and for the opening of your registration file.

To avoid any time lag it is up to you to make sure that your inscription with the training register coincides with the commencement of the training. If the inscription with the training register held by the departmental chamber may be made at any time during the year, the inscription at the DFS is logically limited in time in order to follow the beginning and the end of each training cycles.

Furthermore, it is highly recommended that the trainees register with the specialist training clerk of the joint private institution of the National School of Procedure (l'École Nationale de Procédure Établissement Paritaire Privé). Its seminars are organized voluntarily in accordance with a harmonized programme corresponding to the training days of the Training Department for Trainees so as to avoid any overlapping dates and optimize the training of the students. étudiants un enseignement optimal.

The training takes place under the guidance of professionals in accordance with a pre-planned timetable in regional centres.

In order to follow the training inscription at the DFS is compulsory. Anyone who has not taken out an inscription will be refused entry to the seminars.

Each trainee is allocated to a regional centre in accordance with the location of the training supervisor and the catchment area (‘carte scolaire’) established by the training department. Consult the allocation by department table
  
The educational training days take place during the week and are spread over a two year period in the six DFS centres.

They cover themes dealt with in a practical way, mainly in the form of practical case studies taught in small groups. Consult the 2013-2014 timetable of the DFS.

The trainers are specialized according to the subject matter of the modules. They are all practicing bailiffs except for the Accounting module where chartered accountants are invited to provide the training.


4- HE BAILIFF’S PROFESSIONAL EXAMINATION


The training period for the bailiff ends with the professional examination and allows you to enter the bailiff’s profession.

Who may enter for the professional examination ?

*Qualified individuals having a Master of Laws degree or a pre-doctarate diploma in law (Master 1) or a qualification recognized as being equivalent to a Master of Laws degree.
*Individuals having completed the professional training course.
*Individuals having regularly followed the 2 years training at the DFS.
*Individuals who have not yet taken the examination more than 4 times.

How do you take the examination ?

*the examination takes place at least once per year.
*the syllabus and the rules are specified by order of the Ministry of Justice.
*the subject matter of the written papers and oral tests are chosen by a national jury composed of a judge of the supreme court, by either a university law professor or a university law lecturer, 3 bailiffs and a bailiff’s clerk, nominated by order of the Ministry of Justice for a period of 3 years renewable for one further period of 3 years.

*Employment law, criminal law and criminal procedure, proceedings at the employment tribunal – duration 10 minutes – Coeff 1
* Regulations of the profession, the management of a firm of bailiffs, accounting – code of conduct – duration 15 minutes – Coeff 2
